Appeal Court reserves judgement on Anambra election

The Court of Appeal in Enugu on Thursday reserved judgment on a suit challenging the conduct of today’s (Saturday) Anambra State governorship election.

A governorship candidate of the Nigeria Advance Party, Mr. Ifeanyi Okonkwo, is the appellant in the case.

Okonkwo had brought the appeal before the court challenging the dismissal of his suit at a lower court.

He said he was denied fair hearing at the lower court because the trial judge dismissed his case while he had a pending motion at the court.

Okonkwo said while his appeal on the motion was pending at the Court of Appeal, the Independent National Electoral Commission delisted his party. He stated that a Federal High Court in Abuja had in a judgement nullified the provisions of the Electoral Act, which gave INEC power to delist parties.

The aspirant said he brought an application dated April 29, 2013 praying for an injunctive order of the court to INEC not to release the guidelines for the election until his party had been reinstated.

Okonkwo, who represented himself in the court, stated that he supported his application with a 12-paragraph affidavit and three exhibits.

He said he filed another affidavit of 16 paragraphs supported with 10 exhibits on September 16, 2013.
