Court strikes out alleged fuel subsidy suspect’s application

A Lagos High Court, Ikeja on Tuesday struck out an application filed by a fraud suspect, Mr. Seun Ogunbambo, seeking an order to quash the charges of N4.4bn fuel subsidy fraud instituted against him and others by the Economic and Financial Crimes Commission.

Others, who were charged along with Ogunbambo are Mamman, son of a former Chairman of the Peoples Democratic Party, Ahmadu Ali; Christian Taylor, and their firm, Nassaman Oil Services.

Justice Adeniyi Onigbanjo struck out Ogunbambo’s application on Tuesday for lack of diligent prosecution.

Neither Ogunbmbo nor his lawyer was present in court on Tuesday, a development which the judge attributed to lack of diligent prosecution of the application.

But the other defendants in the suit and their lawyer, Mr. Toyin Pinheiro (SAN), were in court.

“Application filed on June 21, 2013, asking that charges against the fourth defendant be quashed is struck out for lack of diligent prosecution,” the judge ruled.
