Taraba State Governor, Mr. Danbaba Suntai, has dragged the Speaker of the State House of Assembly, Mr. Haruna Tsokwa and 15 other members of the House to court over their rejection of the letter he transmitted to the House, informing the lawmakers that he had returned from overseas treatment and could resume work.
In a suit filed by his counsel, Alex Iziyon, SAN, at a Jalingo High Court, Danbaba wants the court to determine whether the House, by virtue of Section 190 (11) of the constitution, has the powers to deliberate on his letter before he could resume work.
In the originating summons, the governor asks the court to determine whether he has not complied substantially with Section 190 (II) of the constitution and whether the assembly has the right to debate the letter.
At the hearing of the suit in Jalingo on Wednesday, the presiding judge, Justice Ali Andeyantso of High Court 3, who is the vacation judge, granted the prayers of the plaintiffs for a leave for an accelerated hearing of the case during vacation.
The court also abridged the time to five days for the defendants to appear and file a counter affidavit and heir written addresses to the plaintiffs originating summons and other processes.
It also granted leave for substituted service by pasting the papers in the premises of the assembly.
The matter has been adjourned to September 12 for the hearing of the originating summons.
